Have you been getting this response in writing, should a "lemon law" settlement be necessary in the future? Have you tried another dealer? You might want to contact Subaru directly: http://www.subaru.com/tools/contactus/index.jsp . Possibly ask to have a meeting with an area representative. Never accpet that as a answer from a dealer, without him putting you in the same car on the lot and prove it. That usually calls thier bluff.
