karinvail Posted April 16, 2006 Share Posted April 16, 2006 I got rear-ended Monday (the 10th), and then pushed into the car in front of me. I tried to get to the shoulder to avoid the car in front of me as I was being pushed, but it caught the drivers front corner to the SUV's rear passenger bumper and I was pushed under his bumper. A lot of obvious damage to the front, but the back bumper took the majority of the damage to the back. The back hatch doesn't work too well and the body seems to be tweaked a little. Coincidentally, a nurse at my doctors office saw immediately after the accident happened, and she thought the elderly gentleman (who thought he was pressing the break and was gassing it into me instead) was driving what she though might be a Honda, and it was a total mess she said. After I settle with his insurance, I'll probably be parting it out - or I might just let them take it away, haven't decided. The corner is pushed so far in, that it leaked from the radiator and the battery was pushed back. How much do you think they will give me to get another car? I'm afraid I won't get enough to get another car, and I can't afford to use our Suburban to run errands, it gets horrid gas mileage. I have terrible back/neck pains (was in ER for 8 hours with all kinds of tests), so I need to go to town at least 2x's a week for physical therapy. So, I *need* another Soob...... GeneralDisorder Posted April 16, 2006 Share Posted April 16, 2006 Tell them you will take not a penny less than $2000. Especially if it was 4WD and in decent shape. Argue that you'll have to replace it's "function", not neccesarily with the exact same car. Personally I wouldn't take any less than $2000 for ANY running car as insurance settlement - there is my personal time and effort and missed work and all that other stuff to consider if someone wrecks my car. Not to mention I have to find another one and take the time and effort to customize it as I like. They won't go for that, and will offer you a low ball figure. Just say: "Well - I have been having a bit of neck and shoulder pain, and I really don't think I should sign anything before I see my doctor anyway..." Seriously - not your fault so they pretty much know they are going to lose. If it goes to court - represent yourself and use the "spirt of the law" argument. Judges love that. DON'T settle for less - you have an obligation to the rest of us to fight them tooth and nail. Insurance rape is so wrong. They are banking on you needing to settle quick in order to get another car. Post in the wanted forum and someone will come up with something for you cheap. Just wait them out. The longer the case goes un-settled the more likely they are to give you what you want.
