Yo'J
...after inspecting the damnage.. a total of.... $130 something? Where is the emocon for slapping your self in the face? close enough... for a "totalled", but driveable ea81 wagon. Had no dents, all plastic, all working parts fully upgraded. Minus fees and deductible. They say they can find fair market value at $3oo and like $15? Uhh, I'll take three thank you! Any one else down>? Drive the cost up. I admit a drivers side doors and b pillar fix professionally would be very expensive on a new car, more than the cost of a un wrecked ea81 but $130 something? I haven't sent receipts or anything yet so I haven't made my claim yet but this is 2009 and this is just a note to keep your receipts. We will see how this goes. This was a hit and run so I can't sue anyone. I could only get under insured motorist coverage. I wonder what they would give for health? monstaru
get ahold of edrach.......he has some type of claim on an ea81 vehicle that has been going on for a while now.whatever he has it is lots and lots of information.cheers, brain
crash321
First off, why would you turn in $130 in damages to your car. That is something you should take of yourself. Turning in a claim is only going to jack your rates, even if it wasn't your fault. I say (at the risk of pi$$ing you off) suck it up and absorp the cost and get it fixed:-\

The repairs would be exp[ensive and the insurance company is saying the car is only worth $130 dollars. Tell thenm Bullcrap. Cost of replacing it with a working, driveable car is going to be WAY more than $130. They are lowballing you. Don't accept it. they will offer you more if you hold out. Pontiac6KSTEAWD
Going from what I know in recent experience. You have the right, if in a accident, and the fault is not yours, to request, and demand, the car be repaired to its condition prior to the accident, even if this means custom, or other prefab work. If the insurance company scoufs at you about it, calmly tell them that your lawyer will be getting in contact with them, hang up the phone, and get a lawyer involved. Only recourse is small claims court which is relatively inexpensive to file and lawyers are not allowed! Downside is you have to argue your own case and be meticulously prepared. bratman18
quite right. Only recourse is small claims court which is relatively inexpensive to file and lawyers are not allowed! Downside is you have to argue your own case and be meticulously prepared. Yeah but even Small claims court usually end up costing you more time and money then it would have cost you to fix it yourself. I hate Insurance companies! They love to take all your money all year long but when it comes time they never want to help you out! I had a someone back into my old Impreza. I had four quotes at body shops and the lowest one was 600. The ins. comp. would not go over 300! It always happens like this and the people that need it the most get the biggest hassles! Gloyale
Seriously, tell them no. They know they should and will have to pay you more unless you agree to this lowball that they shove at you, and tell you you have to take. Guess what? You don't have to take it. They need you to sign an agreement to the offer or else they can't *close* the case. And They HATE open cases. Becasue open cases turn into lawsuits and cost them more money. They need you to sign off and release them from any further liability. DON"T DO IT! YOU HAVE THE UPPER HAND! THEY KNOW THEY NEED TO GET YOU TO SIGN! DANGLE THAT OVER THEM< THREATEN LAWYERS. BUT ABOVE ALL GET OUT THOSE RECIEPTS AND GET AN AUTOTRADER. Dig up reciepts for tires, clutch, stereo, new seats, any major engine work(not oilchanges) that will show that this wasn't a beater being driven to death, but a fine running commuting machine that you were maintaining and driving regulary. they need to replace it with something that will be the same for you, or at least enough money to buy something close. $130 dollar won't cover the new regisration, let alone the car! Just keep refusing there offer and providing them with ads in you're area for similar transportation. Not the same car nessecarily, but vehichles of the same size, drivable condition, and somewhat age. The age is not nessecarily relavant. The type of car isn't even particiularly relavant. The general condition is. You had a driveable car. You need to replace it with another drivable car. Ask them where the hell they think you are supposed to buy a $130 drivable car? Keep fighting, for our sake. Some of us may need to justify higher values to insurance componies someday, and we need the precident. A few years ago(2006?) my buddies 88 DL got hit parked on the street. Insurance offered him like $450 for it. He said no, adjuster come out and looked at the brand new matched tires($250), the freshly rebuilt motor($700) The newly revinyled upper door panels(alot of time), the heated Legacy seats($150), and the shiny, waxed and buffed red paint that made it look so good(priceless). He held out, and got $1700. more than 3 times the original offer. Be strong and say NO! Edited January 6, 2009 by Gloyale
bheinen74
and insurance companies will factor price of replacement based on dealers pricing, not ehh private party sellers value. Dealers value are higher, or should be and you can bring that up with them. ask them, what dealer in any state in the US, will have a reliable car maintained and selling for only 135? they will not be able to come back with that answer. best bet they will find a car for 1g from a dealer that is safe. screw them. bratman18
Having just filed a small claims action, filing fee is $25 and $34 to have the papers served by the sheriff. After that your time and effort to present the case properly. Actual court time isn't that great. The only reason I know about it is because I had a friend that bought something and never received the product. So he took the guy to small claims court. The guy never showed up to court....3TIMES! All the guy ever got was a slap on the wrist and told he had to come to court. This went on and on just because this guy wasn't cooperating. So it was the initial small fees but then the several days off work and the gas to go to the court house etc. But all this could be avoided if people would just do what they are supposed to! And yes it will cost the Ins. comp. time and money as well but I'm quite sure they have more of it then the little person that is fighting them. Good luck to both of you with the fight I hope that it comes out in your favor!!

I'm still going through my reciepts organizing them for the scanner. You think 300dpi?

To avoid the 3 year statute of limitation, we had to file suit against the taxi driver who hit the Brat. Our fight is not with him, but the suit is needed to finally establish a court ordered valuation for the Brat. After that it will be more difficult for the insurance company not to pay. We'll see. If they continue to be difficult tell them your going to call in comish, infact if you get someone on the phone that agrees with you at the WA state comish office do a three way call with your insurance company. Ask to speak with a supervisor at the insurance co, tell themn you are holding on the line with a representative with the commissioners office.
