My Poor XT6

I've already mentioned on the XT boards. but I figured I'd put it up here too. Last friday a woman made a left turn from the right lane in front of me.

 

Car was towed, and is now at a body shop for an estimate for repairs. I'm not looking forward to the result :eek:

passenger side wheel is pushed back noticeably, control arm looks mostly straight, couldn't see the leading rod. CV joint BROKE! like axle flopping around. would explain why it would roll a bit in park, but I could still drive it forward 10 ft or so out of the road.

woah! worse than i expected. the suspension stuff would all be simple - i've replaced a few of those. just swap out whatever is bent - control arm, rods, struts, hubs. that's rather easy.

 

that freaking fender though, woo, that thing got plowed. not a horrific fix but not a party either.

there's one in my local parts yard that you could get parts off of......Not sure about the fender, but i am pretty sure the hood, lights, bumper, suspension is good.

It might be a FWD model.

 

they are pretty cheap. they give you a choice to pull it yourself or have them.

What was the excuse she gave you for hitting her?

 

she never even tried for an excuse. her account of what happened on the police report was completely wrong. thank goodness there were some pedestrians on the sidewalk to back up my story.

 

Although, she had her mother at the car. Talk about a stereotypical truth :rolleyes:

Geez! That was worse then I expectied. I'm glad you have by-standers to back you, Hope all works out, are you thinking about going to a boneyard for parts or what?

 

btw, hows the X-member? Did it shift with the Control arm?

she admitted that I had the right of way in the statement, so she wasn't trying to get out of anything. she was just so clueless, she still didn't know where I came from. really no argument about who was at fault. and I'm sure the collision shop quote will be $2-3k. so I'm pretty sure they'll total it out. really the only thing left to argue is the value of the car so they can cut me a check.

#1 I am so sorry, that is a neat car and it isn't it's fault it got pranged up

 

#2 I'm a motorcylcist my blood is absolutely boiling over her lack of attention, good people get hurt and killed by idiots like that but shooting her on the spot is still considered illegal

 

#3 glad it wasn't something that hurt you or your passengers

Got a letter from the insurance company yesterday. Because the woman who was driving wasn't the owner or policy holder, and they haven't contacted the insurance company, they're assuming that she didn't have permission to drive the car, and as a result are "respectfully denying payment" on the claim.

 

 

that all took long enough that I need to act very soon to sue her. So I need to raise some money.....so I'm offering a discount on EJ swap harnesses:

Wouldn't your insurance company treat her as a "uninsured motorist" at that point?

how's the dash trim in that one???

and column covers big demand for those parts.

 

covers are already gone, but everything else looked intact

wtf is the point of having insurance... :mad:

 

sorry man that's lame, and I hope you really stick it to them - the best part is, you probably would have been happy getting your car fixed, and any other bills paid - but by the time the lawyers get through fighting for their pay it'll add thousands and thousands of dollars

 

I had a car accident go from 5K to 47K that way, if the damn company had been honorable in the first place instead of juking me around they would have saved 42K :rolleyes:

I am not sure about your state laws with insurance, but here in Texas, as long as someone is not specifically excluded (ie listed as non driver on policy) then the insurance covers the car, and HAS to pay. Pursue the insurance company, their just trying to juke you

yea, the insurance company isn't in the clear, I'm making phone calls like mad lately......ugh...

 

 

anyway, talked to the MN Insurance Commissioner, and they're going to put pressure on the company, but I might have to talk to the WA state one as the agent is based out there.

 

I have called the company stating that if the car wasn't reported stolen, even though it received substantial damage, obviously she had permission. they talked me in circles for awhile, until I gave up.

 

I have decided to get the ball rolling on the lawsuit, though, even though it might not end that way. Maybe if she gets served, she'll realize I'm getting paid, and I don't care who's pocket it comes out of, she'll do the right thing and contact the insurance company.
